Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of ZestySpace — the portfolio website platform, dashboard, and hosted portfolio pages (together, the “Service”). By creating an account, or by using an account created for you, you agree to these Terms. If you do not agree, please do not use the Service.

• You must provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.
• Accounts may be created directly (self-serve signup with a trial) or provisioned for you by our team. Temporary passwords must be changed on first login.
• You must be at least 18 years old and authorised to act for the business you represent.

• Paid plans are billed through Razorpay on the schedule shown at purchase (for example, yearly). Trial accounts get full access for the stated trial period.
• If a payment fails or a subscription lapses, access to the dashboard may be paused and your portfolio may be unpublished until payment is restored.
• Plan limits (such as the number of images and categories) depend on your plan. We may adjust limits with reasonable notice.
• Fees are non-refundable except where required by law or expressly stated otherwise.

• You retain full ownership of the photos, videos, and text you upload. You grant us a limited licence to store, process, and display that content solely to operate the Service (including resizing, watermarking when enabled, and serving via content delivery networks).
• You are responsible for having the rights to everything you publish — including client photos, people’s likenesses, music in videos, and trademarks.
• Portfolio pages are public. Anything you publish may be viewed, shared, and indexed by search engines.

You agree not to use the Service to:

• publish unlawful, infringing, defamatory, or obscene content;
• impersonate another person or business, or mislead visitors;
• upload malware or attempt to breach, overload, or disrupt the platform;
• scrape other users’ content or harvest personal data;
• resell or sublicense the Service without our written consent.

We may remove content or suspend accounts that violate these rules, with notice where practicable.

Pro plans may connect a custom domain. You must own or control any domain you connect, and you are responsible for its registration and DNS costs. We may disconnect domains that infringe third-party rights.

We aim for high availability but the Service is provided “as is” and “as available”. We may update, improve, or discontinue features. For material changes that reduce core functionality, we will give reasonable notice.

• You may stop using the Service and request account deletion at any time.
• We may suspend or terminate accounts for breach of these Terms, non-payment, or legal requirement. Where reasonable, we will warn you first and give you a chance to export your content.

To the maximum extent permitted by law, ZestySpace is not liable for indirect or consequential losses, loss of profits, or loss of data caused by events beyond our reasonable control. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of India.
